1. Creator Service Overview

Kat’s Purr Co. offers a website and online shop where you can browse and purchase creative products made available by Creator.

Products may include, but are not limited to:

  • Handmade artwork and crafts
  • Beaded tapestries and pony bead creations
  • Mirrors and decorative pieces
  • Paintings and other original artwork
  • Digital patterns and downloadable files
  • Digital artwork and other digital products
  • Limited-edition and one-of-a-kind pieces
  • Other products offered through the Service

Individual products may have additional information, requirements, or terms provided on their respective product pages.

2. Eligibility

You must be at least 13 years old to use the Service.

By using the Service, you represent and warrant that:

4.3 Returns and Refunds

All sales are final.

Because our Products may be handmade, one-of-a-kind, limited in quantity, or digitally delivered, we do not generally accept returns, exchanges, or refunds for change-of-mind purchases.

This includes physical artwork, handmade pieces, digital patterns, digital files, and other Products offered through the Service.

If a Product arrives damaged, defective, significantly different from its listing, or you receive the wrong Product, please contact us as soon as possible with your order information and clear photographs or other documentation of the issue.

Digital Products are not eligible for returns or refunds simply because you changed your mind or no longer want the Product.

Nothing in these Terms limits any return, refund, cancellation, or other consumer rights that cannot legally be excluded.

5. Shipping and Delivery

Physical Products will be shipped according to the shipping options and delivery information provided at checkout.

You are responsible for providing an accurate shipping address and for any applicable shipping charges shown at checkout.

Delivery times may vary depending on the Product, destination, shipping method, fulfillment process, and circumstances outside of our control.

Digital Products are delivered electronically through the Service or by the method described on the applicable Product page.

6. Handmade and One-of-a-Kind Products

Many of our physical Products are handmade or individually created.

Because of the handmade nature of these Products, minor variations in color, texture, placement, measurements, or other details may occur.

Product photographs are intended to represent the Product as accurately as reasonably possible. Colors may appear differently depending on your monitor, device, lighting, or display settings.

Unless otherwise stated, these natural variations are not considered defects.

One-of-a-kind Products may not be reproduced exactly.

7. Digital Products and Patterns

Digital Products purchased through the Service are licensed to the purchaser for personal use unless the applicable Product listing states otherwise.

Purchasing a digital pattern or file does not transfer ownership or copyright of the underlying design to the purchaser.

Unless expressly permitted by Creator, you may not:

  • Resell a digital pattern or file;
  • Share or redistribute a digital pattern or file;
  • Upload a digital pattern or file to public or private file-sharing services;
  • Reproduce a digital pattern for distribution;
  • Claim a Creator-created pattern or design as your own;
  • Modify and resell a Creator-created digital pattern or file; or
  • Include the digital file itself with another product being sold or distributed.

7.1 Finished Crafts Made From Our Patterns

Unless a specific Product listing states otherwise, you may use a purchased pattern to create physical crafts for yourself or for sale.

Permission to sell a physical craft made using one of our patterns does not grant permission to resell, redistribute, reproduce, or share the digital pattern itself.

8. Licenses

8.1 Limited License

Subject to your continued compliance with these Terms, Creator grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Service and purchased digital Products for their intended purposes.

8.2 License Restrictions

Except where otherwise permitted by applicable law or expressly authorized by Creator, you may not:

  • Reproduce, distribute, publicly display, or publicly perform our digital Products or other copyrighted Materials;
  • Modify, reproduce, or redistribute our Materials for unauthorized purposes;
  • Circumvent or interfere with security or access-control features of the Service;
  • Attempt to gain unauthorized access to the Service or another person's account; or
  • Sell, transfer, sublicense, or otherwise distribute access to purchased digital Products.

8.3 Feedback

9. Ownership and Intellectual Property

The Service and all original materials made available through it, including artwork, designs, illustrations, photographs, graphics, patterns, logos, branding, written content, product designs, and other creative materials (“Materials”), are owned by Creator or used with appropriate permission.

Your purchase of a Product does not transfer copyright, trademark rights, or ownership of the underlying creative work to you.

Except as expressly permitted by these Terms or by Creator in writing, all rights in the Materials are reserved.

10. Prohibited Conduct

By using the Service, you agree not to:

  • Use the Service for any illegal purpose or in violation of applicable laws;
  • Infringe or misappropriate the intellectual property or other rights of Creator or any third party;
  • Copy, reproduce, distribute, or resell our digital Products without permission;
  • Upload, distribute, or share our digital files or patterns without permission;
  • Circumvent security or access-control features of the Service;
  • Reverse engineer or attempt to discover source code of the Service except where expressly permitted by applicable law;
  • Upload or distribute viruses, malware, spyware, worms, or other malicious code;
  • Interfere with the operation of the Service or its servers or networks;

CREATOR DISCLAIMS WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, TO THE EXTENT PERMITTED BY LAW, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT GUARANTEE THAT THE SERVICE WILL ALWAYS BE AVAILABLE, UNINTERRUPTED, SECURE, OR ERROR-FREE.

NOTHING IN THESE TERMS IS INTENDED TO EXCLUDE OR LIMIT ANY WARRANTY, RIGHT, OR PROTECTION THAT CANNOT LEGALLY BE EXCLUDED OR LIMITED.

16. Limitation of Liability

Fourthwall may provide services related to storefront hosting, payment processing, order processing, product fulfillment, shipping, customer support, returns, refunds, and other transaction-related functions.

Your use of Fourthwall's services may also be subject to Fourthwall's own terms, policies, and agreements.
